I Couldn't Hear The Miranda Rights
Question: I could not hear the Miranda Rights being read due to background noise distractions. What does this mean for my case?
Answer: Assuming that the not reading of the Miranda is very important to your case, then we would look at issues of: Was the distraction intentional? Was the officer aware of the distractions? Did you inform the officer that you could not hear and ask for them to be reread? All factors that would have to be considered in making our arguments to the judge.
