What If I Interrupted The Officer?
Question: I interrupted the arresting officer while he/she read my Miranda rights. Can this help my case?
Answer: I’m not sure that you can take your interference in the process and then try to use it to your advantage. You still have your rights and they still should be imparted to you. But if you impeded the officer from informing you and they continued interrogating you, it would be an issue—a very fact-specific issue—that a judge would have to decide. This is not a question that I think we could just say “yes” or “no” to.
